This essay surveys the main objections to aesthetic hedonism, the view that aesthetic value is reducible to the value of aesthetic pleasure or experience. Hedonism is the dominant view of aesthetic value, but a spate of recent criticisms has drawn its accuracy into question. I introduce some distinctions crucial to the criticisms, before using the bulk of the essay to identify and review six major lines of argument that hedonism's critics have employed against it. Whether or not these arguments suffice (...) to refute hedonism decisively, I argue that its privileged status, as the sole contender in aesthetic value theory, is detrimental to downstream research on aesthetic phenomena. Dynamic Epistemic Logic is the logic of knowledge change. This book provides various logics to support such formal specifications, including proof systems. Concrete examples and epistemic puzzles enliven the exposition. The book also offers exercises with answers. It is suitable for graduate courses in logic. A speaker's use of a declarative sentence in a context has two effects: it expresses a proposition and represents the speaker as knowing that proposition. This essay is about how to explain the second effect. The standard explanation is act-based. A speaker is represented as knowing because their use of the declarative in a context tokens the act-type of assertion and assertions represent knowledge in what's asserted. I propose a semantic explanation on which declaratives covertly host a "know"-parenthetical. A speaker (...) is thereby represented as knowing the proposition expressed because that is the semantic contribution of the parenthetical. I call this view parentheticalism and defend that it better explains knowledge representation than alternatives. As a consequence of outperforming assertoric explanations, parentheticalism opens the door to eliminating the act-type of assertion from linguistic theorizing. (shrink)

William Whewell’s 19th century philosophy of science is sometimes glossed over as a footnote to Kant. There is however a key feature of Whewell’s account worth noting. This is his appeal to Aristotle’s form/matter hylomorphism as a metaphor to explain how mind and world merge in successful scientific inquiry. Whewell’s hylomorphism suggests a middle way between rationalism and empiricism reminiscent of experience pragmatists like Steven Levine’s view that mind and world are entwined in experience. I argue however that Levine does (...) not adequately explain exactly how mind and world entwine. He could nonetheless do so if he appealed to Whewell’s hylomorphic metaphor. We may prefer a reductive metaphysical explanation, but I suggest that pragmatists only have recourse to metaphor in this case. Both reductive and metaphorical explanations can enjoy great explanatory power if they exhibit a suitable measure of what I will call sematic distance. Semantic distance measures how close or how far apart explanandum and explanans are from each other in meaning. Metaphorical explanation - as evident in Whewell’s hylomorphism and as detailed via the notion of semantic distance - presents a valuable new explanatory tool to those who hold that mind and world are entwined sans recourse to metaphysics. Paul Cilliers has developed a novel post-structural approach to complexity that has influenced several writers contributing to the current complexity literature. Concomitantly however, Cilliers advocates for modelling complex systems using connectionist neural networks (rather than analytic, rule-based models). In this paper, I argue that it is dilemmic to simultaneously hold these two positions. Cilliers’ post-structural interpretation of complexity states that models of complex systems are always contextual and provisional; there is no exclusive model of complex systems. This sentiment however appears (...) at odds with Cilliers’ promotion of connectionist neural networks as the best way to model complex systems. The lesson is that those who currently follow Cilliers’ post-structural approach to complexity cannot also develop a preferred model of complex systems, and those who currently advocate for some preferred model of complex systems cannot adopt the post-structural approach to complexity without giving up the purported objectivity and/or superiority of their preferred model. Autism research is increasingly moving to a view centred around sensorimotor atypicalities instead of traditional, ethically problematical, views predicated on social-cognitive deficits. We explore how an enactivist approach to autism illuminates how social differences, stereotypically associated with autism, arise from such sensorimotor atypicalities. Indeed, in a state space description, this can be taken as a skewing of sensorimotor variables that influences social interaction and so also enculturation and habituation. We argue that this construal leads to autism being treated on a (...) par with other sensorimotor atypicalities such as blindness or atypical height. This leads to our conclusion that, insofar there is an ethical call to inclusion in our public sphere regardless of contingent bodily difference, an enactivist take on autism naturally leads to extending such inclusion to autism. Moreover, our analysis suggests a concrete way forward to achieve inclusion of autistics: by being more attentive to autistic sensorimotor specifics. (shrink)

This paper provides a retrospective and prospective overview of TU Delft’s approach to engineering ethics education. For over twenty years, the Ethics and Philosophy of Technology Section at TU Delft has been at the forefront of engineering ethics education, offering education to a wide range of engineering and design students. The approach developed at TU Delft is deeply informed by the research of the Section, which is centered around Responsible Research and Innovation, Design for Values, and Risk Ethics. These theoretical (...) approaches are premised on the notion that technologies are inherently value-laden, and as such contain the possibility of fostering or hindering moral values. Each of these approaches encourages students to take a proactive attitude with respect to their projects and profession, thinking creatively about – and taking responsibility for – how to both prevent harm and do good via the technologies they help develop. To explain how this is put into practice, this paper sketches a brief history of ethics teaching at TU Delft, outlines current activities, and presents future plans for Bachelor and Master’s level engineering ethics education at TU Delft. In the last decade, many problematic cases of scientific conduct have been diagnosed; some of which involve outright fraud others are more subtle. These and similar problems can be interpreted as caused by lack of scientific objectivity. The current philosophical theories of objectivity do not provide scientists with conceptualizations that can be effectively put into practice in remedying these issues. We propose a novel way of thinking about objectivity for individual scientists; a negative and dynamic approach.We provide a philosophical conceptualization (...) of objectivity that is informed by empirical research. In particular, it is our intention to take the first steps in providing an empirically and methodologically informed inventory of factors that impair the scientific practice. The inventory will be compiled into a negative conceptualization, which could in principle be used by individual scientists to assess objectivity of scientific practice. We propose a preliminary outline of a usable and testable instrument for indicating the objectivity of scientific practice. (shrink)

Confucius is one of the most influential figures--as historical individual and as symbol--in world history; and the Analects, the sayings attributed to Confucius and his disciples, is a classic of world literature. Nonetheless, how to understand both figure and text is constantly under dispute. Surprisingly, this volume is the first and only anthology on these topics in English. Here, contributors apply a variety of different methodologies (including philosophical, philological, and religious) and address a number of important topics, from Confucius and (...) Western "virtue ethics" to Confucius' attitude toward women to the historical composition of the text of the Analects. Predictive processing is an increasingly popular approach to cognition, perception and action. It says that the brain is essentially a hierarchical prediction machine. It is typically construed in a representationalist and inferentialist fashion so that the brain makes contentful inferences on the basis of representational models. In this paper, I argue that the predictive processing framework is inconsistent with this epistemic position. In particular, I argue that the combination of hierarchical modeling, contentful inferentialism and representationalism entail an internal inconsistency. Specifically, (...) for a particular set of states, there will be both a representation requirement and not. Yet a system cannot both be required to represent a certain set of states and not be required to represent those states. Due to this contradiction, I propose to reject the standard view. I suggest that predictive processing is best interpreted in terms of reliable covariation instead, entailing an instrumentalist approach to the statistical machinery. (shrink)

For Nietzsche, both the Greeks' shame and their respect for shame played important and healthy psychological and social roles. So, Nietzsche praises shame in the sense that "care [Scham] for one's reputation" is characteristic of noble types and a "highly (...) resourceful" emotion. In this work we answer a long standing request for temporal embeddings of deontic STIT logics by introducing the multi-agent STIT logic TDS . The logic is based upon atemporal utilitarian STIT logic. Yet, the logic presented here will be neutral: instead of committing ourselves to utilitarian theories, we prove the logic TDS sound and complete with respect to relational frames not employing any utilitarian function. We demonstrate how these neutral frames can be transformed into utilitarian temporal frames, while preserving (...) validity. In order to develop a hermeneutic-phenomenological analysis of testimony, this essay will first argue that testimony is “said in many ways” without being homonymous and that contemporary epistemological approaches to testimony are not capable of accounting for all paradigmatic forms of testimony. Second, it is argued, following and extending the work of Paul Ricoeur, that by emphasizing the sense of engagement or Bezogenheit as a basic characteristic of testimony, we may find another approach to testimony that offers a phenomenological alternative (...) to the observational model of witnessing and the accompanying conception of testimony as report. A conviction had by many Christians over many centuries is that natural language is inadequate for describing God. This is the doctrine of divine ineffability. Apophaticism understands divine ineffability as it being justified or proper to negate statements that describe God. This paper develops and defends a version of apophaticism in which the negation involved is metalinguistic. The interest of this metalinguistic apophaticism is two-fold. First, it provides a philosophical model of historical apophaticisms that shows their rational coherence. The concept of impetus denoted the transmission of a power from the mover to the object moved. Many authors resorted to this concept to explain why a projectile keeps on moving when no longer in contact with its initial mover. But its application went further, as impetus was also appealed to in attempts to explain the acceleration of falling bodies or the motion of the heavens. This essay takes Arthur Danto’s end-of-art thesis as a case in point of a substantive philosophy of history. Such philosophy explains the direction that art has taken and why that direction could not have been different. Danto never scrutinized the philosophy of history that his end-of-art thesis presumes. I aim to do that by drawing a distinction between what I refer to as the common view of history and the philosophical view of history, and by arguing that we need the (...) latter if we want to properly assess the plausibility of the end-of-art thesis. The introduction of laws of nature is often seen as one of the hallmarks of the Scientific Revolution of the seventeenth century. The new sciences are thought to have introduced the revolutionary idea that explanations of natural phenomena have to be grounded in exceptionless regularities of universal scope, i. e. laws of nature. The use of legal terminology to talk about natural regularities has a longer history, though. This article traces these earlier uses.

We were slightly concerned, upon having read Eric Winsberg, Jason Brennan and Chris Surprenant’s reply to our paper “Were Lockdowns Justified? A Return to the Facts and Evidence”, that they may have fundamentally misunderstood the nature of our argument, so we issue the following clarification, along with a comment on our motivations for writing such a piece, for the interested reader.

This article addresses the fiduciary issues raised by the current practice of plan fiduciaries of not only disclaiming any fiduciary responsibility for brokerage window investments, but also abdicating any role (fiduciary or otherwise) in assessing even the general suitability of those investments for a retirement plan, and concludes that the practice is in plain and notorious violation of what ERISA requires of fiduciaries.

The paper provides an introduction to the public discourse around the notion of smart healthy inclusive environments. First, the basic ideas are explained and related to citizen participation in the context of implementation of a “society for all ages” concept disseminated by the United Nations. Next, the text discusses selected initiatives of the European Commission in the field of intergenerational programming and policies as well as features of the COST Action NET4Age-Friendly: Smart Healthy Age-Friendly Environments. The following sections are focused (...) on studying and discussing examples of projects and methodologies that have been aimed at: empowering facilitators of smart healthy inclusive environments, empowering citizens to deal with health emergencies, and supporting older people’s voices. Under a policy first enacted in 1988 and expanded in 1996, federally funded public housing authorities (“PHAs”) and private landlords renting their properties to tenants receiving federal housing assistance have been required to include a provision in all leases under which drug-related criminal activity as well as criminal activity that in any way poses a threat to other tenants or nearby residents constitutes ground for initiating eviction proceedings. This strict liability eviction policy, which has become known as the “One-Strike Rule,” (...) was part of a broader congressional effort to combat the “reign of terror” that Congress believed drug dealers were imposing on public housing and assisted housing tenants. Like many of the crime-related policies enacted in the 1980s and 1990s, the One-Strike Rule has done little to reduce crime rates, but has been wildly successful in ensuring that the situation of poor households receiving federal assistance remains highly precarious. Calls for reform of the One-Strike Rule are almost as old as the policy itself, but given the political outlook of the current administration, the prospects for reform at the federal level are dim. While federal law and a combination of gridlock and unwillingness in the congressional and executive branches foreclose a range of possible strategies for reform, there is nonetheless room to mitigate the socially corrosive effects of the One-Strike Rule through legislative efforts at the state and local level. Courts in various jurisdictions have upheld state laws that protect vulnerable tenants despite the federal strict liability policy, and these holdings help to provide a framework for how state and local governments seeking to protect tenants can do so without their efforts necessarily falling prey to the Supremacy Clause. This article describes that framework and proposes three concrete measures that fit it. The article is structured as follows: after explaining the One-Strike Rule and the threat it poses to vulnerable tenants (Section II), the article discusses the burden the Rule imposes on tenants and the benefits it is supposed to bring to other parties, and argues that the resulting distribution of burdens and benefits is unjust (Section III). The article then lays out three concrete measures that state and local governments can enact to protect tenants who face eviction for criminal activity under the Rule without falling prey to a federal preemption challenge: requiring “good cause” for eviction, giving tenants the right to cure a breach of their lease, and providing tenants with free counsel in landlord-tenant court (Section IV). Horology refers to the measurement of time, as well as the art of building instruments with which to study and measure time. There were two important developments in the early modern period: the dramatic improvement of the quality of mechanical clocks due to highly skilled craftsmen, and the introduction of the pendulum as time-keeper in the escapement mechanism. The latter innovation not only allowed a further jump in precision, it also had important conceptual implications.

STIT logic is a prominent framework for the analysis of multi-agent choice-making. In the available deontic extensions of STIT, the principle of Ought-implies-Can (OiC) fulfills a central role. However, in the philosophical literature a variety of alternative OiC interpretations have been proposed and discussed. This paper provides a modular framework for deontic STIT that accounts for a multitude of OiC readings. In particular, we discuss, compare, and formalize ten such readings. We provide sound and complete sequent-style calculi for all of (...) the various STIT logics accommodating these OiC principles. We formally analyze the resulting logics and discuss how the different OiC principles are logically related. In particular, we propose an endorsement principle describing which OiC readings logically commit one to other OiC readings. (shrink)

In its recent opinion in Intel v. Sulyma, the U.S. Supreme Court clarified what qualifies as the “actual knowledge” required to trigger ERISA’s three-year statutory period. The Court’s opinion, however, left open whether establishing “actual knowledge” by a plaintiff in one case serves to time-bar otherwise timely suits that challenge subsequent breaches of the same character. This article argues that, under the continuing fiduciary duty analysis that the Court set forth in Tibble v. Edison, such suits should not be deemed (...) untimely. (shrink)

Akin to the mathematical recreations, John Wilkins' Mathematicall Magick (1648) elaborates the pleasant, useful and wondrous part of practical mathematics, dealing in particular with its material culture of machines and instruments. We contextualize the Mathematicall Magick by studying its institutional setting and its place within changing conceptions of art, nature, religion and mathematics. We devote special attention to the way Wilkins inscribes mechanical innovations within a discourse of wonder. Instead of treating ‘wonder’ as a monolithic category, we present a typology, (...) showing that wonders were not only recreative, but were meant to inspire Wilkins' readers to new mathematical inventions. Wim van der Steen charts conceptual foundations of evolutionary biology and, on the basis of this, he evaluates applications of evolutionary theory outside biology. Philosophical analysis shows that key notions of the theory such as fitness, adaptation, selection, and optimality are empty place-holder concepts that call for context-dependent specifications of meaning. For example, as he points out, the notion of optimality is empty without a specification of constraints. Hence, the controversial thesis that animals perform optimal behaviors as a result of (...) natural selection is meaningless rather than true or false. Analysis shows that many other controversies in evolutionary biology are spurious. Thus, the thesis of genic selectionism, which puts genes at center stage in evolutionary theory, is best reconstructed as an arbitrary conceptualization without substance. Disagreements over the thesis are futile. They reflect preferences for different conceptualizations which are ultimately equivalent. As concepts are properly specified, van der Steen asserts evolutionary theory turns out to be a body of interesting natural history at a low level of generality. General laws of evolution do not exist. Hence, evolutionary approaches do not allow sweeping claims about human nature. Unfortunately, in disciplines outside biology such claims are often defended with evolutionary approaches. Evolutionary theory also cannot serve as a foundation for normative views in ethics or epistemology. This is an important and controversial work for scholars and advanced researchers in biology and the philosophy of biology. (shrink)

VAN MOSSEL C, ALFORD M and WATSON H. Nursing Inquiry 2011; 18: 278–289 Challenges of patient‐centred care: practice or rhetoric.

The objective of Working Group 4 of the COST Action NET4Age-Friendly is to examine existing policies, advocacy, and funding opportunities and to build up relations with policy makers and funding organisations. Also, to synthesize and improve existing knowledge and models to develop from effective business and evaluation models, as well as to guarantee quality and education, proper dissemination and ensure the future of the Action. The Working Group further aims to enable capacity building to improve interdisciplinary participation, to promote knowledge (...) exchange and to foster a cross-European interdisciplinary research capacity, to improve cooperation and co-creation with cross-sectors stakeholders and to introduce and educate students SHAFE implementation and sustainability. To enable the achievement of the objectives of Working Group 4, the Leader of the Working Group, the Chair and Vice-Chair, in close cooperation with the Science Communication Coordinator, developed a template to map the current state of SHAFE policies, funding opportunities and networking in the COST member countries of the Action. On invitation, the Working Group lead received contributions from 37 countries, in a total of 85 Action members. The contributions provide an overview of the diversity of SHAFE policies and opportunities in Europe and beyond. These were not edited or revised and are a result of the main areas of expertise and knowledge of the contributors; thus, gaps in areas or content are possible and these shall be further explored in the following works and reports of this WG. But this preliminary mapping is of huge importance to proceed with the WG activities. In the following chapters, an introduction on the need of SHAFE policies is presented, followed by a summary of the main approaches to be pursued for the next period of work. The deliverable finishes with the opportunities of capacity building, networking and funding that will be relevant to undertake within the frame of Working Group 4 and the total COST Action.
